The Biomet M2A Magnum MDL Has Settled—Can I Still File My Case?

The Biomet M2A Magnum Hip Settlement Agreement

A Biomet M2A Magnum hip settlement agreement was reached in January, 2014. Eligible plaintiffs include those who underwent Biomet M2A Magnum hip revision surgery as a result of injury from the metal implant. Those who are eligible must also have had the revision surgery more than 180 days after it was implanted. According to the agreement, any case which has not served a “materially completed fact sheet by December 31, 2013, is required to serve a materially complete fact sheet no later than June 6, 2014.” While the settlement agreement does not require plaintiffs to have an attorney, there are a number of enhancements and deductions associated with the agreement. This means a plaintiff may be entitled to considerably more than the base payment amount, however might not be aware of that fact without an experienced Biomet M2A Magnum hip lawyer to assess the plaintiff’s case.

What about Biomet M2A Magnum Hip Compensation?

Patients who were harmed by a Biomet M2A Magnum hip implant and are eligible under the Biomet M2A Magnum hip settlement agreement may be entitled to the following compensation. The base award for eligible plaintiffs under the Biomet M2A Magnum hip settlement is $200,000. Deductions to this base award include the following:

·         If you underwent Biomet M2A Magnum hip revision surgery more than 5 years prior to the settlement agreement, but fewer than 8 years following the initial implantation, the plaintiff may be subject to a $10,000 deduction from the base award.

·         If you underwent Biomet M2A Magnum hip revision surgery more than 8 years prior to the settlement agreement, but less than 10 years following the initial implantation, the plaintiff may be subject to a $20,000 deduction from the base award.

·         Cases believed by Biomet to be time-barred, will receive only a one-time payment of $20,000.

·         Plaintiffs who underwent revision surgery but later died from complications unrelated to the revision surgery will have a one-time $20,000 payment paid to his or her estate.

There are numerous other deductions, enhancements and other caveats to the base award, and it is advantageous to have a Biomet M2A Magnum hip lawyer who can help you understand what you are entitled to.
